Terms of Sale

These Terms of Sale apply when you buy Ashigrain, an OpenFX plugin for DaVinci Resolve and other compatible host applications on Mac (see host compatibility), from the Ashigrain website. The publisher of Ashigrain is Red Phoenix Team OÜ, registry code 17501315, Sepapaja tn 6, 15551 Tallinn, Estonia, [email protected] (“we”). More details are in the Legal notice. The Ashigrain app for iPhone and iPad is sold through Apple’s App Store; see Ashigrain for iPhone and iPad.

What you buy

  • A perpetual, single-user license to use the Ashigrain plugin on one Mac at a time, as set out in the End User License Agreement (EULA).
  • Downloads of every release of Ashigrain from your account page, including all future updates and new major versions, at no extra cost. There are no paid upgrades. The EULA explains what we commit to for updates.
  • Activation of the plugin through your account, which removes the trial watermark. The plugin renews its activation online and works offline for up to 30 days between renewals.

Before you buy, you can try the plugin for free: without a license, it renders with an “ASHIGRAIN TRIAL” watermark. The system requirements list what you need.

Price and payment

The price is shown on the pricing page. It is a one-time payment, not a subscription. The price shown excludes VAT: VAT for your country is added at checkout, and the checkout page shows the full price, including VAT, before you pay. The total shown at checkout is the amount you pay.

Payment is taken through Stripe Checkout with Stripe Managed Payments. The purchase is sold through Link (Sold through Link, LLC), Stripe’s consumer brand, which is the merchant of record: it charges you, calculates and collects VAT or sales tax, issues your receipt and appears on your bank or card statement. Link’s buyer terms, shown at checkout, apply to the payment. We never see your card details.

Your account

You need an Ashigrain account with a confirmed email address to buy. Your account gives you access to your licence, downloads and Mac activation. Keep your password secure. Your account is personal: you may not share it. You can delete it at any time on your account page; deleting it ends your license (see the Privacy Policy).

Delivery

Ashigrain is digital content supplied without a physical medium. Once payment is confirmed, we add the licence to your account and send a confirmation email. You can then download and activate the plugin from your account.

Right of withdrawal and the money-back guarantee

Before checkout, on the pricing page, you must tick a box by which you:

  1. expressly ask for immediate access to the download; and
  2. acknowledge that you lose your 14-day statutory right of withdrawal once the download is made available.

Independently of that, we offer a 14-day money-back guarantee: ask within 14 days of your purchase and we refund it in full, with no reason needed. The Refund Policy explains how to request a refund, when refunds are available after this period, and how a refund affects your licence.

Conformity and liability

We are responsible for Ashigrain being in conformity with its description on our website and in its documentation. If it is not, write to us and we will fix it within a reasonable time; if we cannot, you are entitled to a price reduction or a refund. As a consumer in the EU you have these statutory rights for digital content for at least two years from supply. Liability is set out in the EULA. Nothing in these terms limits the rights you have as a consumer under the law of the country where you live.

Your data

We store account, order, licence, activation and download records to provide your account and deliver your purchase. The Privacy Policy explains what we keep, why, who processes it and for how long.

Ashigrain for iPhone and iPad

The sections above cover the Mac plugin bought on this website. The Ashigrain app for iPhone and iPad is sold differently:

  • Where you get it. The app is downloaded from Apple’s App Store. Your use of it is governed by Apple’s Licensed Application End User License Agreement, not by the Ashigrain EULA for the Mac plugin.
  • Free use. The app can be used without paying. Your first 5 exports have no watermark at any resolution. After that, exports up to 854 pixels on the long edge (480p) stay free of the watermark. Exporting at full resolution without the watermark requires the “Ashigrain Pro” subscription.
  • Subscription. “Ashigrain Pro” is an auto-renewing subscription, offered monthly or yearly, that removes the watermark at every resolution. The yearly subscription may start with a 7-day free trial for new subscribers. Prices and trial terms are shown in the app before you subscribe.
  • Billing, cancellation and refunds go through Apple. Apple charges the subscription to your Apple Account and renews it automatically unless you cancel at least 24 hours before the end of the current period. Apple handles free trials, cancellations and refunds. You manage or cancel the subscription in your Apple Account’s subscription settings, and you can restore it on another device with “Restore Purchases” in the app. We do not take payment for the app and cannot cancel or refund an App Store subscription ourselves; refund requests go to Apple at reportaproblem.apple.com. Apple’s Media Services Terms and Conditions apply to the purchase.
  • Separate from the Mac license. An iPhone and iPad subscription and a Mac license are separate products. A subscription does not include a Mac license, and a Mac license does not unlock the app. The app does not need an Ashigrain account.

Changes to these terms

We may revise these terms for future purchases. Your purchase remains governed by the version in force when you bought it. The date at the top shows the latest revision.

Law and disputes

These terms are governed by the law of the Republic of Estonia. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you may bring a claim in its courts. Otherwise, disputes go to Harju County Court (Harju Maakohus) in Tallinn.

If you have a complaint, write to us first and we will try to resolve it. If we cannot, consumers can turn to the Consumer Disputes Committee (Tarbijavaidluste komisjon) of the Estonian Consumer Protection and Technical Regulatory Authority, ttja.ee, or to the consumer dispute bodies in their own country.
